The court documents state that Durr, of Magee, used excessive force on an arrestee while he was handcuffed.

The indictment made the allegation that while the victim was handcuffed to a bench, which was bolted to the floor, and the victim had leg irons on his ankles, that Durr struck the man in the head with the hand grip of his Taser.

Allegedly, Durr also kicked the arrestee in the head and he became uncousious.

Durr will face a maximum of ten years in prison if he is convicted of the charges, which are deprivation of civil rights under color of law.

More information will be released as it becomes available.
