COLUMBUS, Ohio ( WCMH ) — A 20-year-old facing charges over a fatal shooting outside a Waffle House near Ohio State’s campus apologized in a court appearance on Friday morning.

Jaquan Curry is accused of killing Ronald Diggs, 38, on April 29. In an arraignment hearing in Franklin County Municipal Court, he was given a $1 million bond, ordered to stay away from the Diggs’ family and told to not possess firearms. He is due back in court on Sept. 13.

Prosecutors read a statement from Diggs’ mother. It included, “He took my son away from my family. We want justice for my son.” Later, when Judge Jessica D’Varga asked Curry if he had any questions, all he said was “I’m sorry” toward family members.

Curry was arrested Thursday in Canal Winchester by members of the U.S. Marshals Service, a unit called SOFAST, for Southern Ohio Fugitive Apprehension Strike Team.

In April, Columbus police responded to the Waffle House on North High Street, across from the Ohio Union, after an overnight fight broke out among 15-20 people. Diggs was found on a sidewalk having been shot.

Witnesses told police they saw Curry repeatedly punch Diggs before pulling out a gun and shooting him. Diggs was taken to a hospital and died minutes later.

An arrest warrant was immediately issued for Curry, who remained free for four months.
