    Federal judge dismisses GOP lawsuit over counting postmarked mail ballots in Nevada

    A federal judge in Nevada has dismissed a lawsuit filed by Republicans and former President Donald Trump's campaign challenging state law regarding mail ballots received after Election Day.

    The Republican National Committee and the Trump campaign filed the lawsuit in May, arguing the state law, which allows ballots received up to four days after Election Day as long as they are postmarked by Election Day, had "clearly violated federal law." Democrats and state officials defended the law and elections in the state as "the most secure, transparent, and accessible elections in the country."

    Judge Miranda Du of the U.S. District Court for the District of Nevada granted a motion to dismiss the lawsuit Wednesday, ruling that allegations made in the lawsuit were "too speculative to support standing."

    “The Nevada mail ballot receipt deadline does not have an ‘individual and personal’ effect on the voting power of Republican voters; it neither undermines their access to the polls nor disproportionately diminishes the weight of their votes relative to other Nevada voters,” Du wrote in the ruling.

    "That Democrats’ mail ballots are counted, and that this inherently reduces Republicans’ political power in the state, is an incognizable generalized grievance about the 'composition and policymaking' of elected officials," she added.

    Claire Zunk, the RNC's election integrity spokesperson, told the Associated Press that the committee is "committed to protecting the ballot, and we will pursue further legal action in this case." Zunk also said the decision Wednesday was "a liberal judge" who "unjustifiably dismissed our case."

    Voters in Nevada and across the country will take to the polls on Nov. 5.

    The Cook Political Report has rated Nevada as "lean Republican." The RealClearPolitics polling average shows Trump leading President Joe Biden, 47.7%-42.6%, in the Silver State. The former president did not win the state in 2016 or 2020.
