A New Mexico judge who presided over Alec Baldwin’s manslaughter case has slammed prosecutors for misconduct, accusing them of preventing the actor from preparing his defense for the trial.

The judge dismissed the case against Baldwin, citing that the prosecution intentionally withheld critical evidence from Baldwin’s legal team. According to TMZ , the evidence included live ammunition found on the “Rust” movie set that matched the bullet that tragically killed cinematographer Halyna Hutchins. During the trial, police investigator Marissa Poppell testified that her superiors instructed her to create a report documenting the receipt of ammunition and file it under a case number other than the “Rust” case, which was concealed from the actor’s legal team.
District Court Judge Mary Marlowe Sommer told the prosecution in her final written order that their “willful and deliberate misconduct” left her with no option but to dismiss the case. She criticized the prosecutors for “egregious discovery violations constituting misconduct and false testimony elected during trial.”

Baldwin’s case was dismissed last month, and he is reportedly planning to sue Santa Fe Sheriff Adan Mendoza and special prosecutor Kari Morrissey, who Sommer prominently criticized. After his case was dismissed, the actor thanked his supporters in an Instagram post.
“There are too many people who have supported me to thank just now. To all of you, you will never know how much I appreciate your kindness toward my family.”
