An actress and her film producer husband are suing their luxury apartment’s developers for $8 million in damages, alleging that their $6.2 million luxury NYC pad left them exposed to intense ultraviolet radiation. At the 43-story skyscraper near East 40th Street, Jennifer Betit Yen described the apartment’s sun exposure as like taking a “lethal UV bath” in a blog post about her battle with the building’s owners. According to Yen, she was told that the apartment’s windows had been UV-treated and protected before moving in. However, Yen, who is a skin cancer survivor, claimed she began to develop “suspicious lesions” around 2.5 years into living in the apartment. “I am in this surreal situation where I unknowingly basically sat in a potentially lethal UV bath almost every day, during peak sun hours, thinking I was safe, for several YEARS,” wrote Yen. Lawyers representing the developers told the New York Post that Yen and her husband should have inspected the apartment “to their satisfaction” if sun exposure “was such an important issue.”
