    Town of Irondequoit announces preliminary settlement in I-Square lawsuit

    ROCHESTER, N.Y. (WROC) — The Town of Irondequoit announced a preliminary settlement in its lawsuit against the I-Square development Monday.

    The town filed the lawsuit in November , claiming the development and the nearby Brookside Cottages violated town and state codes.

    “This is great news for Irondequoit and a massive step forward,” Irondequoit Town Supervisor Andrae Evans said in a statement Monday. “Settling this issue has been a large priority, and I am grateful that the Board and I-Square have come to an agreement.”

    According to a statement, the town will drop the lawsuit once I-Square and its developers meet the conditions outlined in the settlement. Those conditions were not made public, but when filing the lawsuit, the town said I-Square violated fire codes, made access difficult for first responders, lacked discrete addresses for each unit, built 14 Brookside Cottage units instead of the planned 20, and left an empty gravel lot along the Titus Avenue side of the development.

    The town said it asked developer Mike Nolan to fix the issues multiple times, but he refused to even resubmit a new plan. Nolan has since sold the Market portion of the development to new owners. He continues to manage the rest of the development, but told News 8 other portions of the property were still for sale .

    does the town have inspectors as the project is being built or do they outline the can and cannots of a build?
