Police bodycam footage showed Binney slurring his words during the arrest. The crash occurred in Bixby, near Tulsa, where Shelby, a beloved cheerleader and a sophomore, was found lying on the road outside a rolled-over vehicle. Her mother and two siblings, also involved in the accident, were taken to the hospital with minor injuries.

Investigators determined that Shelby had been ejected from the vehicle, and Elliott Binney, having left the scene, was the driver. Binney, now facing manslaughter charges and charges for leaving the scene of a fatality incident, had previous legal issues, including cases dismissed for similar incidents in 2010 and 2016. At the time of his arrest, Binney exhibited visible injuries.

The crash was reportedly caused by Binney's reckless driving in rainy conditions and an open bottle of vodka was found in the car, indicating possible intoxication.
