Biden Administration Demands Texas Allow Border Patrol Access

Last week, Governor Greg Abbott had the Texas National Guard take over a park in Eagle Pass outraged Mayor Rolando Salinas who should have been notified. Migrants were occupying Shelby Park.

The park was also used as part of Operation Lone Star to stage military vehicles and boats since it is adjacent to the Rio Grande River. 

Now the Biden administration said Texas is disrupting the operations of the U.S. Border Patrol. 

According to KSHB, the Biden administration said Texas had until the evening of January 17 to stop blocking border patrol with access to Shelby Park. 

Department of Homeland Security General Counsel Jonathan Meyer wrote in a letter according to the Catholic Vote:

“The recent actions by the State of Texas have impeded operations of the [U.S.] Border Patrol.”

“Those actions conflict with the authority and duties of Border Patrol under federal law and are preempted under the Supremacy Clause of the Constitution. Texas’s actions also improperly seek to regulate the federal government.”

“I am writing to demand that Texas immediately cease and desist any actions taken by the State that block Border Patrol’s full access to the U.S.-Mexico border in and around the Shelby Park area.”

“Texas’s failure to provide access to the border persists even in instances of imminent danger to life and safety.” 

On Wednesday., January 18, Department of Public Safety spokesman Lieutenant Chris Olivarez posted on X, which is formerly Twitter:

“Under the authority of Gov. @GregAbbott_TX’s Border Disaster Declaration, @TxDPS Troopers are arresting illegal immigrants for criminal trespass at #ShelbyPark in Eagle Pass.”

“Troopers are enforcing criminal trespass on single adult men & women. The State of #Texas will maintain a proactive posture in curbing illegal border crossings between the ports of entry. #OperationLoneStar”

The battle continues between the Biden administration and Governor Abbott.
