SUMNER COUNTY, Tenn. (WKRN) — She suffocated her newborn twins and now a mom from Sumner County is fighting to stay out of jail.

Lindsey Lowe has been free since 2022 after a judge granted her a new trial over an alleged biased juror and poor legal representation. An appeals court said that ruling was a mistake.

In 2013, a Sumner County jury convicted Lindsey Lowe of murdering her twin boys minutes after giving birth to them in the bathroom.

Lowe’s mother found one of the twins hidden in a laundry basket. Lowe’s dad took the witness stand during her trial.

“She said that there is a newborn child in Lindsey’s room,” Mark Lowe, Lindsey’s father said.

“I was just trying to keep them quiet.”

That is audio is from Lindsey’s confession in 2011 at the Hendersonville Police Department.

During her trial in 2013, her defense claimed that Lindsey convinced herself that she wasn’t pregnant and no one knew about it.

“Did you know Lindsay was pregnant? “No, I did not,” Mark Lowe said.

After serving almost a decade of a life sentence, Lowe was granted a new trial in 2022 and released from jail after her attorneys claimed one of the jurors was biased against her.

Then late last week, the Tennessee Court of Criminal Appeals said there was no proof of that bias and Lowe should not have been given post-conviction relief.

The court ordered her to surrender to Sumner County authorities but it allowed her to be released on a $75,000 bond while she appealed to the state Supreme Court. It is freedom that prosecutors say she is not entitled to.

The state filed a motion to revoke Lowe’s bond after she was released from jail on Friday.

In a new filing on Monday, Lowe’s attorney wrote that the state’s motion was tardy, and they repeatedly missed opportunities to challenge her bond over the past week.
