One Upstate County is under fire as some of its residents have filed a lawsuit that the South Carolina Public Interest Foundation has now joined.

The suit against Oconee County claims violations of the State Constitution in using public funds for sewer infrastructure that would only benefit the southern end of the County.

The litigation claims that the 25 million dollar bond which was approved by county leaders last year violates the State Constitution in calling for the repayment of the bond by using funds from taxpayers who don't benefit from the project.

Article 10 of the State Constitution prohibits debt from bonds spent for sewage disposal or treatment that only benefits a specific region of the county. Oconee County leadership has denied the claims of the suit and is asking for the suit to be dismissed.

The sewage system is planned for the Fair Play community near I-85 where the 250 plus acre Golden Corner Commerce Park was built and sits empty to this day.
