    Western North Dakota legislator declines to seek recount

    A western North Dakota legislative candidate has declined to demand a recount, Secretary of State Michael Howe said Friday.

    Rep. Kelby Timmons, R-Watford City, came in third place in the June 11 District 26 House primary with 13 fewer votes than Republican challenger Roger Maki.

    The margin did not qualify for an automatic recount but was close enough for a demand recount , which would have been at his campaign’s expense.

    Timmons notified the Secretary of State’s Office that he would not challenge the result, Howe said. Timmons has served in the state House since 2023.

    Rep. Jeremy Olson, R-Arnegard, was the top vote-getter in the District 26 Republican House primary. No Democrats ran for the position.
