    The Supreme Court has weighed in on presidential immunity as Special Counsel Jack Smith prosecutes former President Donald Trump for alleged crimes while he was in the White House.

    The Supreme Court offered a “split decision” in its ruling , finding that Trump has “absolute immunity” for “official acts” carried out while president but no immunity for unofficial acts.

    The Washington Post reports:

    Former president and presumptive Republican nominee Donald Trump faces four federal felony counts in D.C. for allegedly trying to undo Joe Biden’s 2020 election victory. The high court’s 6-3 ruling sends the case back to the lower court to determine when and whether Trump will go to trial.

    Trump has argued that all of his actions as president should be immune from any and all prosecution, and his legal team even absurdly defended a hypothetical scenario in which a sitting president could assassinate a political rival and still be immune from any criminal prosecution.

    Special Counsel Smith is currently leading two high-profile investigations into Trump, one of which involves classified documents found at Trump’s Palm Beach residence, Mar-a-Lago, after repeated attempts made to retrieve them. The other focuses on the events of January 6th and slates of fake electors in an alleged bid to defraud US citizens of the results of a free and fair election Trump lost to President Joe Biden.
