Texas Data Privacy and Security Act enhances consumer control over online personal data

AUSTIN - The Texas Data Privacy and Security Act took effect yesterday, serving as a consumer data privacy and digital transparency measure. The Act gives Texans more control over their personal data online and requires businesses to follow stricter standards on data security and personal data collection.
"The Texas House has always prioritized Texans’ fundamental rights to privacy and personal autonomy, especially as we conduct an increasingly large portion of our lives online,” said Texas Speaker of the House Dade Phelan. "Not only will consumers be given more say over their data, but parents can further safeguard their children against exploitation by Big Tech and online companies through these new protections."
The Act was created from House Bill 4 during the 88th regular session in 2023.
Consumers have the right to know what personal data is collected about them, how it is used, and if it is sold or shared. They can request access to their data and obtain copies. They can also demand corrections and deletion of their data. Businesses must get consent before collecting sensitive data, which includes information on protected classes, health, genetics, biometrics, children, or geolocation. Consumers can opt out of data sales, targeted ads, and profiling. Businesses cannot discriminate against consumers who exercise these rights.
“Today is the culmination of a seven-year effort to give Texans control over their personal data,” said Rep. Capriglione (R-District 98). “For too long, Texans have been subject to security breaches, invasions of privacy and unfair treatment online with no legal recourse. That ends today. Our personal data belongs to us, and now Texans have the tools to make informed decisions online and protect their privacy and security."
