    Police investigate shooting at south Tulsa shopping center

    TULSA, Okla. — An early morning attempted robbery at a marijuana dispensary in south Tulsa ended with the alleged suspect being shot multiple times.

    FOX23 spoke to Tulsa Police who said an employee of the store is listed as the shooter.

    He claims he was just defending his business.

    At around 4 a.m. on Friday, Tulsa Police responded to an attempted burglary at the Bodega Boyz dispensary near 61st and Memorial.

    Investigators said shots were fired as the break-in was underway.

    An employee was sleeping at the business because of a previous break in attempt, according to police.

    "We have one person in the hospital who we believe is going to survive these injuries. We have someone who shot. We recovered all of the evidence including the weapon and we are going to let the DA sort it out," Tulsa Police Capt. Richard Meulenberg said.

    FOX23 went back to the business on Friday afternoon and noticed the shop was boarded up.

    As for the investigation, officers questioned the shooter but did not arrest him.

    "We believe, looking at the circumstances at the time, we did not have probable cause to believe that this person who shot was violating the law," Meulenberg said.

    FOX23 looked up Oklahoma's Stand Your Ground law.

    It said a person is allowed to protect themselves in multiple different scenarios.

    One of them being if the person uses force to stop another person who "entered or is attempting to enter into a dwelling, residence, occupied vehicle, place of business or place of worship for the purpose of committing a forcible felony."

    Muelenberg said the suspect was allegedly reaching into the business to unlock the door when he was shot.

    However, Muelenberg also said they are not the final determining factor on whether the shooter was standing his ground or not.

    He explained what happened next.

    “We're going to put the entire case together. We are going to package it up and give it to the DA's office and the DA will be the person who makes the determination whether this person violated the law and if anything needs to be done prosecution wise," Meulenberg said.
