Miyares leading 16-state coalition asking Supreme Court to hear Wisconsin transgender student case

RICHMOND, Va. (WRIC) — Virginia Attorney General Jason Miyares is leading a 16-state coalition asking the Supreme Court to step in after a Wisconsin court dismissed a complaint filed by parents over their school district’s guidelines allowing students to change their gender identity.

According to Miyares’ office, a group of parents in Wisconsin filed a complaint alleging that their school district’s guidelines, which allow students to change their gender identity without parental consent or notification, violated their rights.

The complaint was dismissed by both the local district court and the Seventh Circuit Court of Appeals, which held that the parents lacked standing to make federal claims.

The 16-state coalition — which is led by Miyares and is made up of Attorneys General from Alaska, Florida, Georgia, Idaho, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Texas, Utah and West Virginia — is asking the Supreme Court to hear the parents’ case.

Parents have the right to be involved in major decisions affecting their children’s lives,” Miyares said in a press release. “This case presents an opportunity for the U.S. Supreme Court to provide much-needed clarity and reaffirm that government officials cannot override parents’ fundamental rights simply because they believe they know better. It is essential that schools work with parents, not against them, to support a child’s wellbeing.”
