Citing recent Supreme Court ruling, Madigan attorneys want majority of corruption charges dismissed

CHICAGO (WBBM NEWSRADIO) - Lawyers for former Illinois House Speaker Michael Madigan are seeking to get at least some of the corruption counts against him tossed out.

Madigan’s lawyers are seeking dismissal of 14 of the 23 counts in light of a US Supreme Court ruling in the bribery case of the former mayor of Portage, Indiana, James Snyder.

The court narrowed the scope of federal public corruption law, finding that it is a criminal act to take bribes before an official act but not if the public official accepts “gratuities” after the act.

“The mismatch between the conduct alleged and the statutes invoked is a fatal defect that precludes this prosecution,” Madigan’s filing says.

In 2022, Madigan was charged with racketeering conspiracy, using interstate facilities in aid of bribery, wire fraud and attempted extortion.
