Sen. Elizabeth Warren (D-MA) suggested Wednesday that Judge Aileen Cannon of the District Court for the Southern District of Florida, who was involved in the dismissal of former President Donald Trump 's classified documents case, was trying out to be "named the next Supreme Court justice."

The View co-host Sunny Hostin asked Warren about her take on the case's dismissal earlier this week.

Cannon dismissed the federal case against the former president Monday over claims special counsel Jack Smith was unconstitutionally appointed to the role by Attorney General Merrick Garland.

"I have to ask a legal question because earlier this week, the judge overseeing Trump’s classified documents trial dismissed the case against the former president," Hostin said. "As a lawyer and law professor, what do you make of the decision and the impact on Trump’s other legal cases like the Georgia election interference one, which is now on pause?"

"Her decision, in this case, just tossing it out for Donald Trump does him a big solid. But this one is clearly not following the law," Warren responded.

"The United States Supreme Court spoke to this very issue about a special prosecutor in 1974 and said, 'yep, totally kosher, fine thing to do,'" Warren added. "And she [Cannon] just said, 'eh, [it's] kind of harmful to Donald Trump.'"

Warren then took aim at Cannon, implying that her dismissal was motivated by her higher court ambitions.

"So you really got to ask yourself what’s going on. Looks like, to me, somebody who is trying out to be named the next Supreme Court justice," Warren opined.

    "Wow," co-host Joy Behar responded.

    "Not good," Warren added.

The Massachusetts senator pivoted to a discussion about the court's importance on Election Day.

"It is the reminder about Nov. 5. We talk about all these issues, we talk about abortion, Voting Rights Act, but understand the United States Supreme Court is on the ballot as well," Warren warned.

"Next president likely to get two, maybe three [justices], and if it is Donald Trump, he has already shown us what he will do to the United States Supreme Court. Not just for another 10 years or so but for a generation to come," she said.

Cannon has been accused of "favoritism" and been called an "activist judge" since she dismissed the federal case against the former president. Smith plans to appeal her decision.

Trump also received a recent Supreme Court ruling earlier in July that granted him broad immunity for some of his conduct as president.

President Joe Biden has seized on recent court decisions in favor of Trump and reportedly made a Zoom call Saturday with the Congressional Progressive Caucus previewing efforts to make major changes to the Supreme Court, including legislation that would create term limits for justices and a new ethics code.
