Sen. Elizabeth Warren (D-MA) said there are enough votes in the Senate to “suspend the filibuster” and codify Roe v. Wade protections.
If Democrats keep control of the Senate and White House and take back control of the House come November, Warren said there are enough votes to codify Roe v. Wade into law. The filibuster allows Congress to delay or block a vote on legislation by preventing debate on the measure from ending.
“We will suspend the filibuster. We have the votes for that on Roe v. Wade,” Warren said on ABC’s The View.
Warren said if Democrats win control of all three governing entities, protecting abortion rights would be the party's first priority in 2025.
“The first vote Democrats will take in the Senate, the first substantive vote, will be to make Roe v. Wade law of the land again in America,” she said.
Warren also said Democrats would only need a slim majority to reach 60 votes.
“We can make Roe v. Wade law of the land if we have, and I have to be clear, we’ve got to have a majority in the House — skinny majority. We can take a really skinny majority in the Senate. I’ll take fifty. And a Democrat in the White House. We have those three things. We will suspend the filibuster,” she said.
Last week, Senate Republicans blocked a bill that would have enshrined the right to an abortion into law in a 44-49 vote.

During her presidential campaign in 2020, Warren advocated ending the filibuster entirely.
"The filibuster is giving a veto to the gun industry," Warren said during a Democratic presidential debate in 2020. "It gives a veto to the oil industry. It's going to give a veto on immigration. ... We are willing to roll back the filibuster, go with the majority vote, and do what needs to be done for the American people."
