    School board adopts federal Title IX changes

    The Wake County school board adopted changes to its own policies on sex-based discrimination during its meeting Tuesday night.

    The board voted 7-2 to amend and expand its own internal policy to align with federal guidelines handed down by the Biden administration. Board members Cheryl Caufield and Wing Ng voted not to adopt the changes.

    The additional protections afforded by the amended policy include protections from discrimination based on gender identity and pregnancy status.

    Caufield suggested disqualifying specific possible circumstances from the amendment’s definition of sexual harassment. These include a failure to use a student’s preferred pronouns, and segregating bathroom and locker room usage based on sex.

    Board attorneys recommended the board not adopt her proposed amendments as they might have put the board in a vulnerable position were it to be assessed by the state for compliance with the federally mandated changes.

    Nationally, school boards are required to adopt similar changes to align with federal law before it takes effect Aug. 1 or risk being out of compliance.
