A former 97th Judicial District attorney has filed a petition to have the current DA removed from office.

Tim Cole, who served as DA from 1992 to 2006, wants Casey Hall thrown out of office because she has been indicted for theft.

Hall was free Friday from the Montague County Jail on $5,000 bail, according to online jail records.

Cole contends in 2022, Hall requested two vouchers from the state for $9,166.67 each to pay to an investigator in her office. He claims Hall endorsed the checks and deposited the money into her personal account.

Cole claims in his petition to that Hall should be removed on the grounds of incompetency and/or official misconduct.

He also asks that she be temporarily removed from office pending a judge’s decision on his petition.

Cole filed a petition to remove Hall from elected office Wednesday in Montague County District Court. It is a civil case.

Hall was indicted by a Montague County grand jury on July 9, booked into jail and released the same day on $5,000 bail.

She was charged with theft of $2,500 or more but less than $30,000 from Montague County, according to the indictment.

The state jail felony is punishable by 180 days to two years behind bars and a fine up to $10,000.

Hall denied guilt and said in a statement, “I am deeply saddened and shocked by the indictment that came down today against me. An indictment is not a conviction. I am confident that the truth will prevail in my favor.”

Anyone charged with a crime is presumed innocent unless proven guilty in court.

Hall lost her bid for re-election in the March 5 Republican Primary to Henrietta attorney Katie Woods Boggeman, who has no competition in the November general election..

Cole lists his residence as Montague County, which is one of three counties included in the 97th Judicial District —Montague, Clay and Archer.

During his terms as DA, he successfully prosecuted several high-profile murder cases but resigned after pleading guilty to a drunk driving charge in Oklahoma in 2006.

Since then he has worked in private practice, taught in law school and has worked as assistant district attorney in both Montague and Wise counties, according to previous TRN stories.
