Florida 'Condo Warriors' Get Around New State Truck Parking Law

Gov. DeSantis H.B. 1203 Has No Teeth. The new truck parking law is only applicable to a few Florida condo associations, thanks to "Kaufman Language." Legislators Knew the Bill was designed this way.

Fort Lauderdale, FL- Florida, known for its vast condo communities and homeowners' associations (HOAs), has recently been the center of a heated debate. A new law, H.B. 1203, was passed to protect homeowners' rights, particularly those who own trucks. However, some HOAs have found a way to circumvent this law, leaving truck owners back in a bind.

    The New Law
Effective July 1, 20242, the new law states that HOAs can no longer prevent "a property owner or a tenant, a guest, or an invitee from parking his or her personal vehicle, including a pickup truck, in the property owner's driveway." This law was seen as a victory for truck owners, who had long been at odds with HOAs over parking restrictions.

Passed earlier this year, the law aimed to give homeowners more freedom to park their trucks in their own driveways, even if they live in HOA-governed communities. The legislation responded to growing complaints from truck owners who faced fines and towing fees simply for parking their vehicles in their driveways.

    The HOA Loophole
Despite the clear mandate of the new law, some HOAs have continued to enforce their existing parking regulations. They are using what is known as the "Kaufman language" in their bylaws. This language includes the phrase "as amended from time to time," which some HOAs interpret as allowing them to ignore the new state law.

    The Impact
This interpretation has led to continued ticketing and towing of trucks in some communities. Truck owners who thought they were finally free to park in their driveways are finding themselves back at square one, facing fines and the inconvenience of having their vehicles towed.

    What Can Truck Owners Do
Truck owners are not without recourse. The new law provides several protections for homeowners. For instance, it prohibits HOAs from enforcing rules on some residents but not others. If truck owners believe their HOA is selectively enforcing parking restrictions, they may have grounds for a complaint.

Truck owners facing fines or towing fees from their HOAs may feel like they have no recourse. However, there are steps they can take to fight back:

    • Review HOA documents: Carefully review your HOA's governing documents to see if they have properly adopted and recorded the necessary amendments to restrict trucks in driveways.
    • Seek legal advice: Consult with an attorney specializing in HOA law to explore your options and determine if your HOA's actions are lawful.
    • Document everything: Keep detailed records of any correspondence with your HOA, including fines, towing fees, and any attempts to resolve the issue.
    • Consider mediation: If you're unable to come to a resolution with your HOA, consider mediation as a way to resolve the dispute.

Moreover, the law requires HOAs to be more transparent. If truck owners suspect their HOA is misinterpreting or misapplying the Kaufman language, they can request to see the association's bylaws and consult with a legal professional.

    The Road Ahead
The situation in Florida reminds us of the ongoing tension between individual property rights and community standards. As truck owners continue to oppose restrictive HOA rules, it remains to be seen how this conflict will be resolved. What is clear, however, is that the debate is far from over.

In the meantime, truck owners in Florida are advised to stay informed about their rights under the new law and to seek legal counsel if they believe those rights are being violated. With persistence and the right information, they can hopefully find a solution that respects both individual freedoms and community aesthetics.
