A Judge denied Disney’s motion to dismiss Gina Carano ‘s discrimination lawsuit , which means it may head towards trial.

The former Mandalorian actress filed a lawsuit against Disney and Lucasfilm in February, accusing them of going to “great lengths” to “destroy” her career because of her political opinions. But in its motion to have the lawsuit dismissed , Disney claimed it was within their “constitutional right not to associate its artistic expression with Carano’s speech.”

Judge Garnett wrote in the filing that Disney did not identify “any evidence — in the Complaint or otherwise — to substantiate a claim that they employ public-facing actors for the purpose of promoting the ‘values of respect,’ ‘decency,’ ‘integrity,’ or ‘inclusion,'” per Deadline .

The filing later notes, “At this stage in the litigation, the Court cannot conclude, as Defendants urge it to, that Plaintiff’s continued employment by Defendants would inhibit or intrude upon Defendants’ rights to expressive association.”

Carano issued a statement on X celebrating the decision.

“I am moved to tears. After a brutal 3 1/2 years, I am being given the opportunity to move forward in the court of law before the judge and my peers to clear my name. I am so grateful for this opportunity,” she wrote. “What happened to me was unacceptable, absurd and abusive, among other things.”

“Thank you to @elonmusk , a man I have never even met, who so graciously gave me a fighting chance,” she wrote. “Thank you for standing for justice for all of humanity. May God bless you and your family for years to come because He has chosen you for such a time as this.”

In her lawsuit, Carano claimed Disney and Lucasfilm “targeted, harassed, publicly humiliated, defamed, and went to great lengths to destroy Carano’s career, all because she made political statements that did not align with what they believed was an acceptable viewpoint.”

But the company claimed “the final straw for Disney” came when she “grotesquely trivialized the Holocaust as comparable to sharp political disagreements” with a social media post that read, “‘The government first made their own neighbors hate them simply for being Jews. How is that any different from hating someone for their political views?’”

This came after Carano already faced backlash for her social media posts criticizing vaccines and the 2020 election outcome.

The actress seeks damages of at least $75,000 and to be hired back onto the show.

She also seeks compensation for the prospective opportunities she had at the time including the Mandalorian spinoff series Rangers of The New Republic .
