    Teen who 'beat' Kaylee Gain in brutal school fight released on court supervision

    The teenager who became infamous for assaulting a classmate on video earlier this year has been handed court-supervised probation, her lawyer revealed. Greg Smith, representing Maurnice Declue, said the case was "resolved" on June 20, leading to Declue's probation and released from juvenile detention after three months.

    Declue admitted to hitting Kaylee Gain when the charge was reduced to second-degree assault by the juvenile officer overseeing the matter, Smith explained. Smith pointed out that the reduction of the assault charge from first to second degree was about intent. "I think she understood the situation, she understood and accepted responsibility for her own conduct," Smith said.

    "We never believed she was guilty of assault in the first degree. That's knowingly causing serious physical injury suggesting that was her intent all along to cause those serious injuries. Under the situation she found herself in, she was acting under the influence of sudden passion."

    Smith has disclosed that his 15-year-old client is currently at home under the supervision of a deputy juvenile officer. "She has certain conditions that she has to meet, counseling, she has a youth mentor, she has community service to complete," Smith elaborated.

    The court will be keeping an eye on her progress with reports due every two weeks. Smith anticipates that an additional six months to a year of judicial oversight might be necessary. He also mentioned that his client is gearing up for the new school term, reports the Mirror US .

    "She's a fantastic student, she said she wants to get back to school," Smith shared with the press. Back in May, a juvenile court judge agreed with the juvenile officer's suggestion not to escalate the case due to Declue's clean record, opting to keep the proceedings within the juvenile system.

    The assault, captured on CCTV , showed Gains suffering seizures after Declue hit her head against the concrete. Gain was hospitalized for a month and then spent another fortnight in rehab. Her lawyer Bryan Kaemmerer informed 5 On Your Side in May that she continues to undergo physical and psychological therapy and faces at least one more surgery to replace the section of her skull removed by doctors to alleviate brain swelling.

    .After a shocking video surfaced, calls have been made by politicians, including Missouri Attorney General Andrew Bailey, for Declue to be tried as an adult. Kaemmerer also insisted on adult charges for Declue, citing a social media post that was later debunked as proof of her remorselessness.

    A social media post emerged with the caption "Should I join MMA or WWE?," alongside a picture of the assault, suggesting DeClue's indifference. However, it was later confirmed that DeClue was in juvenile detention at the time and couldn't have posted it herself, as the account had misspelled her name. Subsequently, Kaemmerer withdrew his earlier statements about the post.
