Automated criminal record expungement takes effect in Delaware. How it works
An automated process to wipe away the criminal records of people in Delaware began on Thursday, Aug. 1, removing barriers to employment, housing and other critical needs, reports Anitra Johnson.
“Passed in 2021, Delaware’s Clean Slate Act legislation automates the process of expunging the records for individuals with eligible criminal histories,’’ Anitra writes. “The State Bureau of Identification is now required by law to regularly identify and remove records that qualify for automatic mandatory expungement.’’
In addition to convictions, data that appears in criminal histories include:
- Driving violations
- Pending charges
- Probation before judgment
- Case dismissal
- Juvenile arrests
“An expungement removes the record from background checks and eliminates the obligation to disclose the information to rental property owners, loan officers, employers, schools and the general public.’’
