    Sunrise Beach construction business owner charged with deceptive business practices

    CAMDENTON, Mo. (KMIZ)

    A Lake of the Ozarks area business owner was charged with several felonies on Monday.

    Ricky Loren Simmons II, of Sunrise Beach, was charged with four counts of deceptive business practices and two counts of financially exploiting an elderly person. A criminal summons was issued for Simmons on Monday. An initial court appearance was scheduled for 9 a.m. Tuesday, Sept. 24.

    According to the probable cause statement, Simmons owns Concrete The Lake LLC in Sunrise Beach and agreed to construct a foundation, basement and driveway on April 20, 2021, for $86,000. The customer allegedly paid $20,000 between May and August 2021 and Simmons allegedly “provided minimal work and no refund,” the statement says.

    In June 2021, Simmons allegedly entered in an agreement with a customer to build concrete stairs, a retaining wall and concrete pad for $22,875, the statement says. The 63-year-old customer allegedly paid $15,000 on June 28, 2021 and Simmons “provided minimal work and no refund,” the statement says.

    In December 2021, Simmons and the company allegedly agreed to another project with a 64-year-old customer to build a foundation that cost $90,260, with $40,000 initially paid on Jan. 13, 2022, the statement says. Simmons again allegedly “provided minimal work and no refund” but also left 23 dump trucks load of dirt, debris and concrete waste on the property, court documents claim.

    Bank records allegedly showed that all of the checks provided by the victims went into Simmons’ account and “very little funds” went to projects, court documents say.

    Any company that ask for a down payment or a progressive payment has no capital and should never be in business. PERIOD
