Lamborghini driver files lawsuit against city after receiving noise fine for car’s factory build

NEW YORK (1010 WINS) – A Staten Island driver filed a lawsuit last week against the city after receiving a fine for the noise from his Lamborghini, arguing that he did not modify the sound and that it’s not fair.

The fine was issued under the Stop Spreading the Noise Act, a law passed last year aimed at cracking down on cars and motorcycles that generate excessive noise.

Anthony Aquilino is now challenging the $800 fine he received after his Lamborghini Huracan Performante was recorded exceeding the city's noise limit near the Lincoln Tunnel.

Aquilino told 1010 WINS that the new law is being unfairly enforced against those who haven't made any modifications.

"The new law was designed to go after people who modify their cars to make them louder," Aquilino said. "My car is unmodified, so I can't change it. I can't do anything about it."

Despite this, Aquilino was still issued a ticket after his car was recorded at 92 decibels, surpassing the 85-decibel limit set by the law.

He disputes the fine, claiming that the law’s enforcement has strayed from its original intent. "The direction from when the law was first written to how it's being enforced now seems a little different," he said.

Aquilino pointed out that the incident also occurred near the Lincoln Tunnel, not in a residential area, and that passersby didn’t even react to the sound of his car. "There were about five or six people on the right-hand side of the street. They didn't pick up their heads," he said.

“The only solution is to sell the car, and I just think that's unfair," Aquilino said.

The city’s Law Department is reviewing the case.

In a statement, the Department of Environmental Protection, which controls the noise cameras, told 1010 WINS: "The New York City Noise Code, which sets the legal limits for noise within the five boroughs, applies to all motor vehicles, whether they have been modified, or not."
