    Gov. Newsom to Sign Bill Enhancing Housing Law Enforcement in California

    On Wednesday, Governor Gavin Newsom announced his intention to sign Senate Bill 1037, a significant housing enforcement bill aimed at bolstering the state’s ability to enforce housing laws. The bill, sponsored by Attorney General Rob Bonta and authored by Senator Scott Wiener, seeks to impose stricter penalties on local governments that violate state housing regulations.

    SB 1037 enhances the Attorney General’s authority to levy civil penalties against cities and counties that fail to comply with housing laws, particularly those that obstruct housing development. Under current law, penalties can only be imposed after a prolonged period following a court’s order for compliance. The new bill, however, allows for penalties to be assessed from the date the violation began, providing a stronger deterrent against non-compliance.

    “When we pass state housing laws, we mean it, and when cities flagrantly violate these laws, they must know they will face consequences,” said Senator Wiener. He highlighted that the bill is designed to ensure that California’s housing laws are not only well-crafted but also rigorously enforced.

    The fines collected from these penalties will be earmarked for the development of affordable housing within the jurisdiction that committed the violation, directly benefiting the communities affected by the lack of compliance. The penalties range from a minimum of $10,000 to a maximum of $50,000 per month for each violation.

    SB 1037 specifically targets local governments that either refuse to adopt a compliant housing element or violate laws requiring ministerial approval for housing projects, such as those allowing for accessory dwelling units or affordable housing in commercial zones.

    Senator Wiener praised Governor Newsom and Attorney General Bonta for their leadership in holding cities accountable for illegal actions that hinder housing production, particularly citing efforts in places like Elk Grove, where housing development has faced significant obstacles.

    The bill represents a critical component of California's broader strategy to meet its ambitious housing goals, ensuring that local governments contribute effectively to resolving the state’s housing crisis.
