Morrissey Claims Johnny Marr Now Owns the Smiths Trademark, Free To Choose Any Vocalist

There has been a recent update on the current Smiths legal debacle, according to Morrissey. It’s like watching two parents fighting over custody of their child. And the fight over who “owns” The Smiths likely won’t be over with this particular update.

The battle between former bandmates of The Smiths, vocalist Morrissey and guitarist Johnny Marr, might not be over yet. Morrissey recently claimed that Marr now owns the trademark rights to use The Smiths’ name for whatever he wishes. He also implied that Marr could very well hire a new vocalist for the band if they decide to plan a reunion.

Last night, Morrissey released a statement on his website discussing the recent development; and he didn’t seem happy about it.

“J Marr has successfully applied for 100% trademark rights / Intellectual Property ownership of The Smiths name,” the post reads. “His application has been accepted on whatever oaths or proclamations he has put forward.”

The “update” goes on to note that the action was done “without any consultation to Morrissey, and without allowing Morrissey the standard opportunity of ‘objection’.” According to the post, this recent development means that Marr can tour, among other things, while using The Smiths name. He can also choose a new vocalist if he wishes, and could prohibit Morrissey “from using the name whilst also denying Morrissey considerable financial livelihood.” The post ends with a claim that Morrissey created the band and its name in May 1982.

What’s The Drama Between Morrissey And Johnny Marr?

Morrissey and Johnny Marr have been butting heads since The Smiths first began and ultimately ended. According to recent news, Morrissey accepted an offer to reunite the band next year, but Marr decided to turn it down. Morrissey has also claimed that Marr blocked a potential move to produce a “greatest hits” album, complete with two vinyl reissues.

While we’ll never know how deep the beef goes between these two, we do know that political differences have had a hand in their inability to agree with one another. Morrissey has espoused a lot of controversial political beliefs, which Marr has decided to distance himself from.

Will a Smiths reunion ever happen, and will Morrissey be involved? Who knows? Fans shouldn’t give their hopes up, but there could be a chance that The Smiths will reunite at some point in time without Morrissey’s participation.
