    Sheriff sale set for Chill Can plant

    YOUNGSTOWN, Ohio (WKBN) – Mahoning County Sheriff Jerry Greene has been ordered to appraise and sell the Chill Can plant and property on behalf of the city of Youngstown.

    The city received a $1.5 million summary judgment, plus 3% interest, in a lawsuit against Chill Can and its owner MJ Joseph Consultants for the failed business venture. The total owed to the city is $2.25 million, which it hopes to recoup in the sheriff’s sale.

    Another $322,907 will go to MS Consultants with 18% interest for the lien it has on the property.

    Three unoccupied buildings still stand on the lower East Side which are now surrounded by weeds. The city owns some of the land, along with investor Scott Berger of Irvine, California.

    The sale order was filed last month in the Mahoning County Common Pleas Court with sale dates of November 11 and November 26, however, the 86 parcels of land were unable to be appraised, according to court records.

    Filings from Greene’s office state that three appraisers were unable to determine the value with the consensus being that Berger and the city co-own parcels within the structure, with both having a vested interest and that the City also owns parcels surrounding the structure.

    The city had hoped to gain control of the property in the foreclosure and sell it.
