    Artem Chigvintsev will avoid criminal charges after domestic violence arrest .

    The Dancing with the Stars pro was arrested for domestic violence on August 29, in Napa Valley and was charged with felony corporal injury to a spouse or cohabitant . The Napa County District Attorney's Office revealed in a press release that Artem would not be getting charged and that the decision "was made after a thorough review of the criminal investigation and careful evaluation of the evidence presented to the DA's Office."

    Napa County District Attorney Allison Haley said: "While we take every arrest seriously and stand firmly against domestic violence , we have an ethical obligation to only file charges when supported by the evidence."

    "We are required to prove any and every criminal charge 'beyond a reasonable doubt' which is the highest standard in the American criminal justice system. If the available evidence doesn't rise to this level of proof, then we cannot ethically file charges."

    It was not revealed who the alleged victim was at the time of Artem's arrest. His wife, Nikki Garcia, filed for divorce from Artem on September 11. He was arrested on August 29. The arrest occurred just days after the two celebrated their second wedding anniversary. Nikki had posted about her husband on Instagram with a video of them from their wedding day in Paris.

    They also share a four-year-old son Matteo, with Nikki allegedly requested legal and physical custody of Matteo.

    Due to media interest, the DA Office wanted to issue a press release on the case. Allison said: "The Napa County District Attorney's Office does not typically issue press releases when it declines to file charges against any given individual; however, did so for this case due to the intense media interest it has received since Mr. Chigvintsev's arrest."

    Sadly, if she was the aggressor and he was just defending himself, the damage is more to him. He now carries the stigma of a DV even if he was just trying to de-escalate the situation, which is totally unfair. The same thing happened to a friend of mine, and we all know it was his wife, but he was arrested because she made a big stink, which she to this day regrets. She actually went to anger management to help their marriage, and 20 plus years later, they are happily married, but his record shows he was arrested, although charges were never formally filed. It's one reason I'm not so quick to pass judgment.
