The bond is currently set at $100,000, cash only.Below are notes taken by KHQA, obtained from the online court hearing.Tyler White's attorney, Mark Williams, said that White is a member of the bar and has always appeared in all of his cases. He has represented him two other times and White has never missed a hearing. Williams believes White will report to the court as required.Williams asked that White be released on his own recognizance. If it is not $50,000 with 10% down or $100,000 with 10% down, Williams believes it would be cruel and unusual punishment.The prosecuting attorney, Jordan Force, said that White missed a Monroe County case recently and that he has also missed a case in Lewis County. These were not for his own charges but missed court appearances when he was representing a client.Force also said that that White has a substance abuse problem. White had a minor intoxication charge in 2011 and has two DUI's pending in Adams County.Judge Burks asked about the victim involved in this case and Force said that the victim's mother is currently on the court hearing call.Force added that the victim is currently out of the hospital and Force has contacted him and his mother. The victim is concerned that White will seek retribution or to intimidate him. The victim wants no contact with White.Williams said his client would be willing to have a substance abuse evaluation and currently, he is still considered an innocent man in Adams County regarding his pending charges. Willilams added that White has no history of intimidation or retribution.Force disagreed that there have not been any reports of intimidation. Force referenced a Macon County case against White where he intimidated a witness. The case was dropped because the victim did not want to testify.Judge Burks reviewed the probable cause statement. Burks said she is required to take into consideration several factors. Considering the allegations in the probable cause statement Burks feels the bond is appropriate where it is at - $100,000, cash only.Judge Burks said as she is not the judge who signed the arrest warrant and won't be assigned to the case, she will schedule another bond hearing with Judge Greenwell for next week on Wednesday, October 2 at 10:00 a.m.</div></body>
