    While acquiring private property by eminent domain is legal, I think that 'fair market value' is not necessarily the correct term to use. The Constitution actually says in the 5th Amendment "nor shall private property be taken for public use, without just compensation". 'Fair market value' and 'just compensation' are not the same thing. There might be a personal or family history connected to a property. What if there is an old family cemetery located on the property, and the current owner believes that exhuming and relocating those remains is a desecration? This adds a religious aspect to the conversation. What is "just" to one person may not be "just" to another.
