The DMV tester is at fault because the diver is being tested to get his license and the tester was supposed to have check the car with the driver to make sure it was ready for the road before leaving for the test.

Who's responsible for the vehicle? The person driving it. End of story. Make sure they have license plates and insurance. A test drive doesn't make traffic laws null and void.
