Officials say that a truck driver involved in a fatal accident with a 9-year-old child will not face charges for the incident.

The crash happened on Highway 50 near Baxter Road in Grand Junction Colorado last month.

According to 8ABC , the tractor trailer was traveling in the correct lane of Highway 50 at a legal speed when the 9-year-old ran into the road in an attempt to cross it. The truck driver was unable to avoid the child and collided with them, leading to their death.

The trucker stayed at the scene after the accident and cooperated with police.

The crash is still under investigation, but the Colorado State Patrol stated this week that the truck driver will not face charges for the accident, citing the significant distance commercial vehicles require to successfully stop.

he should not face charges, he is going through enough guilt and grief right now, it wasn't his fault and could not be avoided
