A mistrial was declared this week in Weld County Court for a man accused of killing his girlfriend’s 18-month-old child in July 2021. District Judge Timothy Kerns granted an unopposed motion to declare a mistrial filed by the defense for 29-year-old Andy Carter, reports the Greeley Tribune. The motion was filed after the prosecution discovered on the fourth day of Carter’s trial that they had not reviewed records from a cellphone belonging to a victim. Carter’s case dates back to July 2, 2021, when he took his girlfriend’s 18-month-old daughter to the emergency room to be treated for a brain bleed.
