Nicki Minaj is close to having to be grilled about her childhood as part of the $150 million wrongful death battle with the hit-and-run driver who fatally struck her father, In Touch can exclusively report.

According to court documents obtained by In Touch, a New York judge granted Charles Polevich’s plea to help him get Nicki, 41, to sit for a deposition.

At a hearing on October 8, the judge granted Charles’ motion for the issuance of an open commission to take the out-of-state deposition of Nicki. The decision allows Charles to take action in California to get Nicki to appear.

Nicki’s mother, Carol Maraj, sued Charles over the February 2021 death of her husband, Robert Maraj.

In court, Charles was accused of hitting Robert with his car as Robert crossed the street in Long Island. Robert was rushed to the hospital but was pronounced dead hours later.

Prosecutors accused Charles of fleeing the scene. They claimed he drove his 1992 Volvo Station Wagon to his home and covered it with a tarp.

The police tracked him down using security footage. Charles was charged with leaving the scene of an accident and tampering with physical evidence.

He was sentenced to one year in jail in 2022. In Carol’s civil lawsuit, as part of her plea for a nine-figure judgment, Carol claimed she lost her husband’s “comfort” and “companionship” following his death.

For months, Charles has been attempting to depose Nicki. He said he wanted to ask her questions about her father and her childhood.

In court documents, he claimed Nicki had accused Robert of domestic violence in past interviews and spoke about her childhood in song lyrics.

Carol opposed the request. Her lawyer argued, “It was also made clear that Nicki is not a party to this action and to have her testify as to musical lyrics, which could be completely made up, false, and taken out of context, was a waste of time and borderline harassment for the family.”

Carol’s lawyer continued, “As this Court and Defendant will surely agree, a majority of, if not all of the lyrics contained in the millions of songs produced yearly are made up, false, fabricated and do not actually contain true facts.”

The judge previously ruled that Nicki’s statements about her childhood were relevant to the case. Charles said he sent Nicki a request to show up for a deposition but never heard back.

“To date, no response has been received from the non-party witness and it is apparent that the non-party witness does not intend to cooperate and voluntarily provide testimony that is material to defense of this action,” Charles’ lawyer added. Now, the judge has allowed Charles to move forward with his attempts to get Nicki to show up for a deposition.

As In Touch previously reported, Nicki and her husband Kenneth Petty were hit with bad news in a separate case earlier this year. In March, Nicki and Kenneth were ordered to pay a security guard named Thomas $503,318 after blowing off a lawsuit over an alleged assault.
