Why would a defense attorney allow the prosecutor to mention traffic violations that old? Who cares about a reckless driving in 2009? Defense lawyers are terrible. They pretend to defend you, but they are actually buddies with a lot of the prosecutors, and they just want you to plead guilty, so they don't have to go to trial.

Sounds like the Subaru driver didn't allow her to get back into the westbound lane to avoid the collision. It takes two. Avoiding getting hit is just as important as avoiding hitting another driver. Avoiding getting hit means sometimes you have to go faster or slow down in order to move away from the driver. Why didn't the Subaru driver let her back into the lane?
