Detroit 36th District Court Judge Kenneth King is arguing he has immunity in the federal lawsuit involving a sleepy teen who he had detained while on a field trip.

King filed a motion Monday to dismiss the case of the girl, Eva Goodman, and her mother, Latoreya Till . The motion argues that even though King spoke to the girl's field trip group between court hearings, he was still acting in a judicial capacity at the time of their interaction and therefore is entitled to immunity. The filing cited case law that judges are immune in civil cases even when they act in error, with malice or in excess of their authority.
