Nearly eight months after the shooting death of Horning’s Hideout co-owner Carl Horning, authorities have made official their suspicion that Carl’s brother was behind the gun.

Horning, 47, was found with multiple gunshot wounds following reports of a shooting at Horning’s Hideout in North Plains, a place for weddings, disc golf, hiking and picnicking, on Jan. 2. He was declared dead at the scene.

As events unfolded earlier this year, authorities made public their suspicions of Robert Horning. And on Monday, July 29, a Washington County grand jury indicted Robert Horning, Carl’s older brother, on charges of second-degree murder and unlawful use of a weapon.

Authorities said after the incident that Robert Horning was at the scene and was initially detained by arriving deputies. Although Robert Horning was released several hours later, he was immediately considered a person of interest in the homicide investigation.

Deputies have kept mum on the ongoing investigation for the following eight months. Further court documents were not immediately available, as of Monday afternoon.

Other court records indicated that there was familial strife over the assets relating to Horning’s Hideout long before the fatal shooting. A civil battle had been playing out in court for months over who would oversee the family matriarch, Jane Horning, and her assets.

Meanwhile, a lawsuit has been playing out in civil court over Carl Horning’s estate .

In the wake of Carl Horning’s death, his wife, Kelli Horning, was named representative for her late husband’s business interests. Her attorney, Heather A. Kmetz, successfully argued that the issue should be settled quickly to protect the estate from Robert Horning, whom the lawsuit lists as having “allegedly shot” his brother.

The filing also states that Kelli Horning anticipates initiating a wrongful death claim, going on to list herself and Carl Horning’s two children — one an adult, the other a minor — as beneficiaries.
