Representatives of local governments worried about their liability when it comes to managing improved recreational trails can breathe a sigh of relief.

The Oregon Legislature approved Senate Bill 1576, which temporarily protects local jurisdictions and other owners of recreational trails from liability. The bill will sunset at the end of 2025 and elected officials have said there will be a deeper look at the law in the meantime.

Last year, a ruling in Nicole Fields v. the City of Newport complicated liability protections for local governments and landowners of improved trails, leading insurance provider CIS Oregon to recommend that cities close recreational trails. Scott Winkels, with the League of Oregon Cities, testified last month that he expected CIS to rescind that recommendation if the bill passes.

The House voted 25-2 to approve the bill and the Senate unanimously approved it.
