NEW YORK (1010 WINS/WCBS 880) -- Hours after releasing video of a man in an alleged attempted kidnapping at a Queens daycare on Tuesday, police said he was no longer a suspect after it was determined he'd been authorized to pick up the child.

"Upon further investigation it was determined that the individual being sought did not commit a criminal offense regarding this incident," the NYPD said in an update.

"The investigation revealed that he was authorized to pick up a child from the location," the update continued.

Police had said he walked into a daycare on Leavitt Street in Flushing on Monday afternoon and told staff he was there to pick up a 3-year-old girl, even referring to her by name.

He told staff that the girl's father would be 20 minutes late, but the staff refused to hand over the child, as he wasn't on the emergency contact list from her parents, according to cops.

The child remained in the custody of the daycare during the incident.

1010 WINS has removed video and photos of the man from this story.
