'He won't win': Experts claim Trump's latest filing in criminal case is a 'long shot'

Legal experts on Thursday had one response to former President Donald Trump's plea that his election interference case judge not release new evidence until after the upcoming election.

"This is a long shot," said Bloomberg law and politics reporter Zoe Tillman . "But stay tuned."

Trump's attorneys requested federal Judge Tanya Chutkan stall until Nov. 14 — more than a week after Election Day on Nov. 5 — releasing sensitive materials they argued would taint the jury pool when covered in the news.

"If the Court immediately releases the Special Counsel’s cherry-picked documents, potential jurors will be left with a skewed, one-sided, and inaccurate picture of this case," Trump's attorneys wrote.

"Those same potential jurors may not see President Trump’s later responsive filing, and even if some do, 'first impressions are prone to remain.'"

Tillman noted this was not the first time Trump cited the upcoming presidential election as a reason to delay in arguments to Chutkan.

"Judge Chutkan has repeatedly rejected efforts to factor the election into her scheduling decisions," Tillman reported.

Former federal prosecutor Joyce Vance argued this argument ignored repeated instructions from Chutkan on arguments she would accept.

"The Judge previously ruled she would release those materials, but gave Trump the opportunity to respond," Vance wrote. "He did so, focusing on politics, despite the Judge's repeated reminders that she is focused on the law and her case, not the election."

Eric Columbus , whose lengthy political resume includes an Obama administration appointment to the Justice department and serving as a litigator for Rep. Nancy Pelosi and then-Sen. Joe Biden, predicted Trump was laying the groundwork for more delays.

"This filing (which Judge Chutkan will not grant) is a prelude to Trump seeking relief from [the Supreme Court]," Columbus wrote. "Look for more filings today, maybe an intermediate stop at the DC Circuit (where he won’t win)."
