ROSWELL, N.M. (KRQE) – A Roswell man facing a charge under Bennie’s Law is now expected to take a plea deal.

In August of last year, police claimed two children got a hold of Phillip Jaramillo’s guns in his Roswell home. They said one of the guns went off and killed Jaramillo’s 10-year-old daughter as she slept in another room.

Jaramillo’s trial was set for this week, but court documents show the trial has been continued as his attorneys and prosecutors work on a plea deal. He’s facing a charge for negligently making a firearm accessible to a minor.

His next court appearance is scheduled for Monday.
