Workers’ Compensation Court of Appeals Digest: July 3, 2024
Self-insured employer, the city of Minneapolis, appealed from the compensation judge’s findings that the employee sustained a compensable post-traumatic stress disorder (PTSD) injury, and that the employee continues to suffer from the compensable PTSD injury. The employer further appealed the compensation judge’s finding that the employee suffered from another mental health condition as a consequence of the PTSD injury. The employer also appeals the award of a penalty for a frivolous denial of primary liability. The Workers’ Compensation Court of Appeals concluded that substantial evidence, including adequately founded expert medical opinions by licensed psychologists, supported the compensation judge’s finding that the employee had a compensable PTSD condition under the DSM. The compensation judge’s consideration of supporting evidence in the records of other medical professionals which influenced and supported the expert medical opinions was not an error of law.
