    ‘Date-rape’ drug testing kits coming to San Diego bars and nightclubs

    SAN DIEGO (FOX 5/KUSI) — California bars and nightclubs, including those in San Diego County, will soon be equipped with “date-rape” drug testing kits.

    This is due to a new state law, known as AB 101 , that will require establishments with a Type 48 license to have “a prominent and conspicuous location” where patrons know drug testing kits are available, explained officials with the Department of Alcoholic Beverage Control (ABC).

    The tests are for common “date-rape” drugs, often referred to as “roofies.”

    A Type 48 license is used by establishments that sell beer, wine, and liquor to those of legal drinking age — 21 and up — which is consumed on the premises, according to ABC. Food service is not required at these types of locations. The department confirmed there are around 2,400 places throughout the state with this type of license.

    Starting July 1, 2024, these establishments must either offer the drug testing devices for sale to customers at a price that doesn’t “exceed a reasonable amount based on the wholesale cost,” or be given to customers free of charge.

    Additionally, each spot must have signage that reads: “Don’t get roofied! Drink spiking drug test kits available here. Ask a staff member for details.”

    Licensees are responsible for obtaining the testing kits, which could include test strips, stickers, straws or other devices that can detect the presence of controlled substances in drinks. Establishments that do not comply with the new law could face actions impacting their licenses.
