    New Texas Law Grants Powerful Rights to Victims of ‘Dating Violence’

    This month, Texas Senate Bill 1841 went into full effect, providing crucial new protections and resources for survivors of dating violence. The bill, which has been praised by advocates for its comprehensive approach, allows victims of dating violence to access services at family violence centers and clearly defines the types of abuse that constitute dating violence.

    Under the new law, dating violence is defined as actions by someone in a dating relationship that result in physical harm, cause the victim to fear for their safety, or involve emotional abuse. This clear definition is a significant step in ensuring that all forms of abuse in dating relationships are recognized and addressed.

    Senate Bill 1841 also amends the Human Resources Code to update the contractual requirements between the Health and Human Services Commission (HHSC) and family violence centers. Among the key provisions, the bill mandates that these centers must use a voluntary and trauma-informed advocacy service model to be eligible for contracts with the state. This approach emphasizes the importance of providing care that respects the autonomy and individual needs of survivors.

    Additionally, the bill revises the list of services that contracted family violence centers are required to offer, ensuring that survivors receive comprehensive support. Importantly, it also specifies that participation in services by victims must be voluntary. Centers are prohibited from requiring survivors to engage in certain services as a condition of receiving shelter, ensuring that victims can access help without unnecessary barriers.

    This legislative change reflects Texas's commitment to addressing intimate partner violence in all its forms and provides a framework for other states to consider as they work to protect vulnerable populations. As SB 1841 is implemented, family violence centers across Texas are preparing to offer expanded support to survivors of dating violence, helping them find safety and begin the healing process.
