BAYONNE, NJ - A former Bayonne recreation department assistant supervisor has filed suit against the city claiming he was underpaid by nearly a million dollars since being hired.

The suit claims that the city failed to pay him minimum wage and is asking the city for back pay as well as money he might have made in investments for a total of $3 million.

According to the suit, the city hired Tyrone Sims under an apparent agreement with his now deceased mother at a rate lower than the legal minimum wage.

While the city cannot comment on pending litigation, an employee familiar with the situation said the city hired Sims with the stipulation that his wages would not jeopardize his Social Security disability payments. The federal government sets a limit on how much a recipient of disability can earn.

The lawsuit claims Sims, who was terminated on Dec. 31, 2018 had not been paid state-mandated minimum wage payments for 30 years. City officials, however, say that Sims was not terminated and is in fact employed in the Department of Public Works.

A source told TAPinto Bayonne that city officials have offered to settle the matter several times with Sims’ family, trying to avoid the heavy tax payouts both he and the city would have to pay.  Jarred S. Freeman, of Edison-based Freeman and Patel LLC is the third attorney the city has negotiated with to settle the issue.
