Shaunna O'Connell's attorney asked for the case against her to be dropped, arguing that Ted O'Connell, the alleged victim in the case, would be refusing to testify. In contrast, the prosecution argued that there was enough evidence to convict the mayor, and asked for the case to go forward to a trial.

The two legal filings described the events of the July 19, 2024 evening when Shaunna O'Connell was arrested after allegedly striking her husband slightly differently.
