Orlando, FL — A federal grand jury has indicted Delta Henry Rushing II, 29, of Orlando, on charges of enticing a minor to engage in sexual activity and committing a felony offense involving a minor while being a registered sex offender. The indictment, announced by United States Attorney Roger B. Handberg, carries severe penalties, with Rushing facing a mandatory minimum sentence of 20 years and the possibility of life in federal prison if convicted on all counts.

The indictment alleges that between November 3, 2022, and December 5, 2022, Rushing, who has a prior conviction as a sex offender, knowingly enticed an individual under the age of 18 to engage in sexual activity. In addition to the criminal charges, the indictment includes a notice of the United States' intent to forfeit any assets used by Rushing to facilitate the offenses.

This case is part of a broader effort by federal authorities to combat child sexual exploitation. The investigation was conducted by Homeland Security Investigations and the Metropolitan Bureau of Investigation. The prosecution will be led by Assistant United States Attorney Kaley Austin-Aronson.

Rushing is presumed innocent until proven guilty, as an indictment is merely a formal accusation of criminal activity.

The charges against Rushing are part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice. This program focuses on addressing the growing problem of child sexual exploitation and abuse. Through collaboration between federal, state, and local law enforcement, Project Safe Childhood aims to apprehend and prosecute those who exploit children and to rescue victims. More information about this initiative can be found at www.justice.gov/psc.
