New Truancy Law Sparks Concern Over Student Absences and Family Impact

SOUTH BEND, Ind. – A new law, enacted this spring, is reshaping how schools address student absences and their impact on families. According to the legislation, after a student accrues five unexcused absences, schools are mandated to schedule a parent meeting within 48 hours. This step aims to curb further absences by alerting local prosecutors through an affidavit, marking the student as having reached their limit.

The law further stipulates that once a student hits ten total absences—whether excused or unexcused—the case is considered habitual. This serious designation could lead to truancy court, fines, or, in severe cases, charges of neglect. Initially applied to grades kindergarten through sixth, the School City of Mishawaka plans to extend these measures to middle and high school students.

“Bottom line is we want students in school,” said Dave Troyer, Director of Student Services at School City of Mishawaka. “When students are in school, they will progress better and reach their potential better than when they are not.”

Despite these efforts, Mishawaka’s attendance records show improvement but still lag behind pre-pandemic levels, with fewer than half of students meeting attendance expectations. Similarly, South Bend Community Schools are revisiting their approach, focusing on personalized interventions and support.

“We meet with principals and review student data to understand the reasons behind absences and determine necessary interventions,” said Dr. Todd Cummings, Superintendent of South Bend Community Schools. “We conduct home visits, make calls, and connect families with external resources.”

Though South Bend's attendance rates have also shown an upward trend, only 42 percent of students are attending as regularly as required. Ongoing efforts aim to address these challenges and enhance student engagement.
